Terms and Conditions of Use      
  GENERAL
VACATIONS KENYA TOURS AND SAFARIS LTD accepts payment by bank draft, money transfer services or cash. All costs and prices indicated are for land services and do not include international airfare. Land costs are based on double occupancy and are priced per person. Single supplements apply to anyone wishing to have their own room but a single room cannot be guaranteed.

All prices are subject to change at any time due to currency fluctuations, or other circumstances beyond VACATIONS KENYA TOURS AND SAFARIS’ control. Most safaris operate with a minimum of two participants. When a safari requires four or more to guarantee departure, we will attempt to indicate this. Please check with us for minimums and availability.

Safaris are booked and confirmed only on receipt of a 50% deposit of the basic program rate and the acknowledgement of the same. After receipt of the deposit, booking packet and invoice will be mailed to you.

Balance of payment is due no later than sixty days prior to the commencement of your trip. If the balance has not been received by that date, we shall be entitled at our discretion to treat your reservation as cancelled and consequently you shall forfeit such part of the deposit as determined (below see cancellation and refunds regarding 31-60 days cancellation charges).

LAST MINUTE BOOKINGS/ LATE BOOKINGS
Any reservation made within 30 days of commencement of a safari is considered LAST MINUTE while reservations within 30-60 days are considered LATE BOOKINGS. They are all acceptable provided space is available, payment in full has been received and adequate confirmation can be delivered prior to departure. There is a surcharge of 40% on last minute bookings and 25% on late bookings under these circumstances per person.

CANCELLATION
Any amount paid will be refunded less the cost of cancellation determined by several factors that include levies by hotel/lodges, food purchases and any other relevant expenses and as indicated below-.

Further to that, cancellation of a booking must be in writing and shall be and only effective upon its acknowledged receipt by VACATIONS KENYA TOURS AND SAFARIS. Refunds will thus be given minus cancellation charges as follows:-
-Minimum fee of $150 per person will be deducted if cancellation is 65 days before departure -A 50% levy on all bookings will be deducted if cancellation is 31-65 days prior to departure -100% deduction if cancellation is 1-30 days prior to departure.
Different cancellation policies apply at different camps or safaris and may be less or more. On group or custom safaris there may be stricter cancellation policies - please inquire.
No refunds are given for lost travel time or substitution of facilities, for itineraries amended after departure or for circumstances arising beyond VACATIONS KENYA TOURS AND SAFARIS’ control. If you do not appear for any accommodation, service, sightseeing, or trip segment; or if you leave your program after it has begun, miss scheduled sightseeing activities, meals, or accommodations there will be no refund.
VACATIONS KENYA TOURS AND SAFARIS LTD reserves the right to cancel any departure, itinerary, or any part of it, to make such alterations in the itinerary as it deems necessary, to refuse to accept or retain as a member of any program any person at any time, and to pass on to program members any expenditure occasioned by delays or events beyond its control. VACATIONS KENYA TOURS AND SAFARIS LTD reserves the right to substitute hotels and services for those mentioned in detailed itineraries when necessary.

GENERAL INFORMATION
All bookings are accepted by VACATIONS KENYA TOURS AND SAFARIS LTD as an independent ground tour operator and also as an agent for hotels, airlines, car hire and bus companies, grounds transportation, boat purveyors or owners, and other independent contractors providing accommodations, transportation and/or other services. These services provided by the independent companies are offered subject to the terms and conditions contained in the tickets, exchange orders and/or vouchers issued by them and/or their suppliers. Because VACATIONS KENYA TOURS AND SAFARIS LTD does not have the right to control the operations of the independent operators and their suppliers in some instances, it will not be held liable for any personal injury or property damage which may arise out of these services. In case of any appreciable variation in its cost, VACATIONS KENYA TOURS AND SAFARIS LTD reserves the right to adjust its rates.

INSURANCE
VACATIONS KENYA TOURS AND SAFARIS LTD strongly recommends that you obtain the following types of insurance which are commercially available: Accidental death and disability; Life insurance; Emergency medical evacuation; Trip cancellation, Major medical, Loss of personal effects.

RATES
Our prices include entrance fees to National Parks and Game Reserves, meals while on safari, transportation and the services of our driver/guides as per itinerary. The rates are based on tariffs and other costs prevailing at the time of printing and are subject to change without prior notice.

TRANSPORTATION
Saloon cars, minibuses, land cruisers, landrovers, coaches or trucks will be provided according to the route and the number of clients and the services of professional, English speaking driver/guides. We reserve the right to use the services of sub-contractors for all or part of the services.

ACCOMMODATION
The standard pricing policy is based on a twin room/tent being shared by two people. A single room/tent will be provided on request at a supplementary cost but cannot be guaranteed.

LIABILITY
VACATIONS KENYA TOURS AND SAFARIS LTD and its agents act only as agents of the passengers in all matters relating to hotel/lodge and tented accommodation, tours and transport etc. and shall not be liable for injury, delay, loss or damage in any manner.

CAUTION
All tours involve an element of personal risk and can be of a hazardous nature. Every participant must accept this risk. We are not liable for any loss, damage, injury, delay or inconvenience caused to you or your baggage as a result, directly or indirectly or any matter of whatever nature which is beyond our control. It should be noted further that game viewing involve wild animals and special care should be taken to ensure safety of all involved.
